Bloom & Horizon operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Bloom & Horizon is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

We are a small studio based in Bengaluru, India, and we sell and ship within India only. Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described here.

Personal information we collect or process

When we use the term "personal information", we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. Depending on how you interact with the Services, we may collect or process the following categories of personal information, including inferences drawn from it:

• Contact details including your name, address, billing address, shipping address, phone number, and email address.
• Payment information including transaction details, form of payment, and payment confirmation. We do not see or store your full card, UPI or bank details — payments are handled directly by our payment gateway, which processes them under its own privacy policy.
• Account information including your username, password, preferences and settings, if you choose to create an account. You can order as a guest without one.
• Transaction information including the items you view, put in your cart, or purchase, return, exchange or cancel, and your past orders.
• Communications with us including anything you write to us, for example when you send a message through our contact form or reply to an order email.
• Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
• Usage information including how and when you interact with or navigate the Services.

Where the information comes from

• Directly from you, including when you place an order, create an account, or write to us.
• Automatically through the Services, including from your device when you browse, and through cookies and similar technologies.
• From our service providers, when we engage them to provide part of the Services and they collect or process your personal information on our behalf.

How we use your personal information

Providing and improving the Services. To perform our contract with you: to process your payment, print and pack your order, arrange shipping, keep you posted on your order, handle a replacement or refund, remember your preferences, manage your account if you have one, and to make the shop work better.

Marketing. If you have signed up to our newsletter, we send occasional emails about new prints and collections. Signing up through the form in our footer adds your email address to our Shopify customer list, tagged as a newsletter subscriber. Every one of those emails carries an unsubscribe link, and we do not sell or rent your email address to anyone.

Security and fraud prevention. To authenticate your account, to provide a secure payment and shopping experience, and to detect, investigate or act on possible fraudulent, unlawful or malicious activity. If you register an account, you are responsible for keeping your credentials safe.

Communicating with you. To answer your questions, provide customer support, and maintain our relationship with you.

Legal reasons. To comply with applicable law, to respond to valid legal process, and to enforce or investigate potential violations of our terms or policies.

Who we share it with

We do not sell your personal information. We share it only with the providers who make an order possible, and only with what they need:

• Shopify, which hosts the store, processes orders and stores our customer records.
• Our payment gateway, which processes your payment and carries out fraud checks.
• Our courier, which needs your name, delivery address and phone number to deliver your parcel.
• Our email provider, which sends order notifications and, if you have subscribed, our newsletter.
• Professional advisers and authorities, where we are required to disclose information by law, or in connection with a business transaction such as a merger or sale.

Each of these providers processes your information on our instructions, or under its own privacy policy where it acts on its own account. We share information with them for the purposes described above and for no other reason.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside. In addition, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. In these circumstances Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over its use for these purposes. Third-party websites and links

The Services may link to websites or platforms operated by third parties. If you follow a link to a site we do not control, you should review its privacy and security policies and its terms. We are not responsible for the privacy or security of such sites, or for the accuracy of information found on them. Our inclusion of a link does not by itself imply any endorsement.

Children

The Services are not intended for children. We do not knowingly collect personal information from anyone under 18 years of age, we do not knowingly use a child’s personal information for advertising, and we do not track or profile children. If you are the parent or guardian of a child who has given us their personal information, write to us at bloomandhorizonstudio@gmail.com and we will delete it.

Security and how long we keep your information

We take reasonable measures to protect your personal information, but please be aware that no security measures are perfect or impenetrable, and information sent to us over the internet may not be secure in transit. We recommend that you do not use unsecured channels to send us anything sensitive.

How long we keep your personal information depends on why we hold it. Order and payment records are kept for as long as the law requires us to retain them for tax and accounting purposes. Newsletter subscriptions are kept until you unsubscribe. Contact-form messages are kept while we deal with your query and for a reasonable period afterwards, in case you write to us again about the same order.

Your rights

Under India’s Digital Personal Data Protection Act, 2023, and any other law that applies to you, you may have some or all of the following rights. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request where the law permits it.

• Access. You may ask for a summary of the personal information we hold about you and how we process it.
• Correction. You may ask us to correct information that is inaccurate or incomplete, or to update it.
• Erasure. You may ask us to delete personal information we hold about you, unless we are required to keep it — order and tax records being the usual exception.
• Withdraw consent. Where we rely on your consent, you may withdraw it at any time. For the newsletter, the unsubscribe link at the foot of every email does this immediately; you can also simply write to us.
• Nominate. You may nominate another person to exercise these rights on your behalf in the event of your death or incapacity.
• Grievance redressal. You may raise a complaint with us about how we have handled your personal information, and we will respond.

To exercise any of these rights, email bloomandhorizonstudio@gmail.com. We answer within one working day and will complete your request as quickly as we reasonably can. We may need to verify your identity first, and we will not treat you any differently for having asked.

Complaints

If you are not satisfied with how we have handled your personal information, please write to us first at bloomandhorizonstudio@gmail.com — we would much rather put it right ourselves. If we cannot resolve it between us, you may lodge a complaint with the Data Protection Board of India, or with your local data protection authority if you are outside India.

Information held outside India

Shopify and some of our other service providers store and process personal information on servers located outside India. Where that happens, we rely on our contracts with those providers to keep your information protected to the standard described in this policy, and we transfer it only to the extent needed to run the shop and fulfil your order.

Changes to this policy

We may update this Privacy Policy from time to time, to reflect changes in our practices or for other operational, legal or regulatory reasons. We will post the revised policy on this page, update the "Last updated" date at the top, and give notice where the law requires it.
